Формування правової та організаційної культури персоналу апарату суду

Abstract

Метою кваліфікаційної роботи є аналіз чинного законодавства та практики його реалізації та визначення практичних аспектів формування правової та організаційної культури в апараті суду, надання відповідних пропозиції та рекомендації щодо її удосконалення. Вирішення фундаментальної проблеми судової реформи, спрямованої на становлення та зміцнення судової влади, забезпечення незалежного та компетентного здійснення правосуддя, здатного захистити права та законні інтереси учасників судового процесу, неодмінно пов'язане з особистістю не тільки самого судді але і працівників апарату суду. Апарат суду - це важлива складова суду як державного органу, що здійснює організаційне забезпечення діяльності суддів, судів та судової влади в цілому, а також система штатних одиниць, наділених відповідними адміністративно-організаційними та розпорядчими повноваженнями згідно із затвердженою організаційною структурою, передбаченою чинним законодавством. В Україні відбувається перерозподіл функцій державного управління та пошук оптимальної структури управління. Створення нової адміністративної системи нерозривно пов'язане з реформою державної служби, оскільки завдання і функції держави виконують державні службовці. Від них значною мірою залежить хід реформ, боротьба з корупцією та захист прав і свобод людини і громадянина, гарантованих Конституцією України.The purpose of the qualification work is to analyze the current legislation and the practice of its implementation and to determine the practical aspects of the formation of legal and organizational culture in the court apparatus, to provide relevant proposals and recommendations for its improvement. Solving the fundamental problem of judicial reform, aimed at establishing and strengthening the judicial power, ensuring independent and competent administration of justice, capable of protecting the rights and legitimate interests of the participants in the judicial process, is necessarily related to the personality of not only the judge himself, but also the employees of the court apparatus. The court apparatus is an important component of the court as a state body that provides organizational support for the activities of judges, courts, and the judiciary as a whole, as well as a system of staff units endowed with appropriate administrative and organizational and managerial powers in accordance with the approved organizational structure provided for by current legislation. In Ukraine, there is a redistribution of public administration functions and the search for an optimal management structure. The creation of a new administrative system is inextricably linked to the reform of the civil service, since the tasks and functions of the state are performed by civil servants. The course of reforms, the fight against corruption, and the protection of human and citizen rights and freedoms, guaranteed by the Constitution of Ukraine, largely depend on them.
