Механізми формування та реалізації державної політики у сфері фізичної культури і спорту в Україні

Abstract

Дисертація є одним із перших у вітчизняній науці державного управління, у ній досліджено характерні особливості державної політики у сфері фізичної культури і спорту в Україні, здійснено аналіз основ її теоретичної концептуалізації, її інституціоналізації, а також перспектив удосконалення її механізмів формування та реалізації. У дисертації досліджено особливості становлення і розвитку державної політики у сфері фізичної культури і спорту в різні історичні періоди. Результатом даних досліджень стало виділення її системоутворюючих чинників у конкретно взятому історичному періоді з урахуванням українських національних особливостей. У дослідженні використовувався міждисциплінарний методологічний інструментарій, який виходить поза межі науки публічного адміністрування і охоплює методи таких близьких за об'єктом досліджень наук, як історичні та юридичні. Дана методологія зумовлена історико-правовим контекстом дослідження сфери публічного адміністрування фізичної культури і спорту у найбільш віддалений і водночас найбільш показовий для українського державотворення період. У процесі дослідження використано наукові розробки вчених, які вивчали державної політики у сфері фізичної культури і спорту в історичні часи. За результатами дослідження встановлено, що досліджуваний державно- 3 управлінський феномен характеризувався особливим контекстом розвитку державної політики, яка передбачала укріплення обороноздатності держави у постійних воєнних кампаніях і це позначилося на сфері фізичної культури і спорту. Дана політика була зумовлена двома системоутворюючими чинниками: необхідністю системного відкриття військово-спортивних шкіл і розвитком фізичної культури на перманентному рівні громад. Зазначений підхід був реалізований двома векторами публічного адміністрування: централізованими підходами щодо відкриття шкіл військово-спортивної підготовки і первинним рівнем наставництва та розвитку спортивних заходів на рівні громад. Обидва рівні такої державної політики забезпечувалися шляхом регулювання даних суспільних відносин нормами звичаєвого права, що стало результатом культивування національних спортивних традицій, найбільш тісним чином пов’язаних із воєнною підготовкою з самих ранніх років і до періоду повноліття. У дисертації зроблено висновок про те, що дана система підготовки на рівні її публічного адміністрування знайшла своє практичне втілення через багаторічний період у різні історичні часи у сучасній моделі. У дисертації досліджено характеристику основних міжнародно- правових умов формування і реалізації національної політики у сфері фізичної культури і спорту. Під час дослідження визначено проблемних і перспективних особливостей удосконалення публічного адміністрування фізкультурно-спортивної сфери у міжнародно-правових умовах. У процесі дослідження використано комплекс загальнонаукових і спеціальних методів, зокрема: аналіз, синтез, індукція, системний підхід, програмно-цільовий метод. Спеціальні методи представлені такими методами, як порівняльно- правовий, телеологічний, формально-юридичний та інші. Метод аналізу використовувався як основний дослідницький метод системи міжнародно- правового регулювання спортивної діяльності. Метод синтезу використовувався при формулюванні авторських висновків, дефініцій та характеристик особливостей впливу міжнародного права на національну 4 спортивну політику. Окрім зазначених методів також використовувався метод висування та перевірки пояснювальних наукових гіпотез. Застосування порівняльно-правового методу забезпечило можливість дослідження порівняння міжнародно-правових основ правового регулювання та реалізації фізкультурно-спортивної політики в Україні. У результаті дослідження у дисертації констатовано порушення функціонального балансу умов формування та реалізації державної політики у сфері фізкультури і спорту, враховуючи наявність міжнародно-правових норм, що зумовлює удосконалення функціонально-структурних механізмів реалізації державної політики з урахуванням глобалізаційних тенденцій розвитку спорту. У дисертації схарактеризовано основні елементи розвитку механізмів державно-приватного партнерства у реалізації державної політики у сфері фізичної культури і спорту в Україні, що базується на удосконаленні чинного законодавства щодо консолідації регуляторного впливу Закону України «Про фізичну культуру і спорт» і Закону України «Про державно-приватне партнерство», що спрямоване на посилення спільної відповідальності влади і комерційного сектору. У дисертації запропоновані інструменти активізації політики державно-приватного партнерства, зокрема застосування контракту повного життєвого циклу, приватний контроль і розподіл відповідальності партнерів. Запропоновано внесення змін і доповнень у чинне законодавство України, а також інституційні удосконалення існуючого механізму державно-приватного партнерства державної політики у сфері фізичної культури і спорту щодо активізації фінансування галузі та підвищення її конкурентоздатності.

The dissertation is one of the first in the domestic science of public administration, it explores the characteristic features of the state policy in the field of physical culture and sports in Ukraine, analyzes the foundations of theoretical conceptualization, its institutionalization, as well as the prospects for improving its mechanisms of formation and implementation. The thesis studies the features of the formation and development of state policy in the field of physical culture and sports in different historical periods. The result of these studies was the selection of its backbone factors in a particular historical period, taking into account Ukrainian national characteristics. The study used interdisciplinary methodological tools that go beyond the science of public administration and cover the methods of disciplines that are close in terms of the object of research, such as historical and legal sciences. This methodology is conditioned by the historical and legal context of the study of the sphere of public administration of physical culture and sports in the most remote and at the same time the most indicative period for the Ukrainian state. In the course of the research, scientific developments of scientists who studied the state policy in the field of physical culture and sports in historical times were used. According to the results of the study, it was found that the studied state-administrative phenomenon was characterized by a special context for the development of state policy, which assumed the strengthening of the state's defense capability in constant military campaigns, which affected the field of physical culture and sports. This policy was 6 due to two system-forming factors: the need for a systemic opening of military sports schools and the development of physical culture at the permanent community level. This approach was implemented by two vectors of public administration: centralized approaches to the opening of schools of military sports training and the primary level of mentoring and development of sports activities at the community level. Both levels of such public policy were provided by the regulation of these social relations by customary law, which was the result of the cultivation of national sports traditions, most closely associated with military training from the earliest years until the age of majority. The dissertation concludes that this training system at the level of its public administration has found its practical implementation over a long period in different historical times in the modern model. The dissertation examines the characteristics of the main international legal conditions for the formation and implementation of national policy in the field of physical culture and sports. In the course of the study, problematic and promising features of improving the public administration of the physical culture and sports sphere in international legal conditions were identified. In the process of research, a complex of general scientific and special methods was used, in particular, analysis, synthesis, induction, a systematic approach, a program-target method. Special methods are represented by such methods as comparative legal, teleological, formal legal and others. The method of analysis was used as the main research method of the system of international legal regulation of sports activities. The synthesis method was used in formulating the author's conclusions, definitions and characteristics of the peculiarities of the influence of international law on national sports policy. In addition to these methods, the method of advancing and testing explanatory scientific hypotheses was used. The application of the comparative legal method provided an opportunity to study the comparison of the international legal foundations of legal regulation and implementation of physical culture and sports policy in Ukraine. As a result of the study, the dissertation stated a violation of the functional balance of the conditions for the formation and 7 implementation of state policy in the field of physical culture and sports, taking into account the existence of international legal norms, which leads to the improvement of the functional and structural mechanisms for the implementation of state policy, taking into account globalization trends in the development of sports. The dissertation describes the main elements of the development of publicprivate partnership mechanisms in the implementation of state policy in the field of physical culture and sports in Ukraine, based on the improvement of the current legislation on the consolidation of the regulatory influence of the Law of Ukraine «On Physical Culture and Sports» and the Law of Ukraine «On Public-Private partnership», aimed at strengthening the common responsibility of the government and the commercial sector. The dissertation proposes tools for activating the policy of public-private partnership, including the use of a full life cycle contract, private control and distribution of partners' responsibility. It is proposed to introduce amendments and additions to the current legislation of Ukraine, as well as institutional improvements to the existing mechanism of public-private partnership of state policy in the field of physical culture and sports to enhance the financing of the industry and increase its competitiveness.
