Нормативно-правове забезпечення діяльності органів місцевого самоврядування у територіальній громаді

Abstract

Зважаючи на той факт, що Україна є частиною європейського простору, наразі відбувається поступова трансформація вітчизняного нормативно-правого забезпечення у галузі діяльності органів місцевого самоврядування у територіальній громаді, з урахуванням позитивного європейського досвіду. Це дозволяє виокремити певні напрямки удосконалення сучасного вітчизняного законодавства, виокремивши, наприклад, потребу в усуненні відчуження громадян від процесу прийняття рішень органами влади різних рівнів. Задля активного долучення громадян до процесу управління громадськими справами на місцях у нашій країні, з огляду на ефективний європейський досвід, повинні використовуватися форми прямої демократії, механізми місцевих референдумів, різні форми роботи громадянського суспільства у місцевих органах влади. В рамках досліджуваного проблемного питання, ми виокремили потребу у можливих напрямках вдосконалення нормативно-правового забезпечення діяльності ОСН: уніфікація правового статусу ОСН; виключення норм, що фактично створюють відносини подвійного підпорядкування ОСН; спрощення процедури створення ОСН; поліпшення фінансових можливостей ОСН; розвиток локального законодавства; оптимізація правового регулювання здійснення ОСН власних та делегованих повноважень. Також доречно звернути увагу на трансформацію нормативно-правового поля у галузі кооперації, взаємодії, співпраці між територіальними громадами, що є важливим засобом проти територіального відокремлення та поділу тощо.

Given the fact that Ukraine is a part of the European space, the national regulatory framework for the activities of local self-government bodies in the territorial community is currently undergoing a gradual transformation, taking into account positive European experience. This makes it possible to identify certain areas for improving the current national legislation, such as the need to eliminate the alienation of citizens from the decision-making process by authorities at various levels. In order to actively involve citizens in the process of managing public affairs at the local level, in our country, taking into account the effective European experience, forms of direct democracy, mechanisms of local referendums, and various forms of civil society work in local authorities should be used. Within the framework of the problematic issue under study, we have identified the need for possible areas of improvement of the regulatory and legal support for the activities of the LBOs: unification of the legal status of the LBOs; exclusion of provisions that actually create relations of double subordination of the LBOs; simplification of the procedure for establishing the LBOs; improvement of the financial capabilities of the LBOs; development of local legislation; optimisation of the legal regulation of the exercise of the LBOs' own and delegated powers. It is also appropriate to pay attention to the transformation of the legal framework in the field of cooperation, interaction, and collaboration between territorial communities, which is an important tool against territorial separation and division, etc.
