Управління діяльністю органів суддівського самоврядування

Abstract

Мета кваліфікаційної роботи - науково-теоретичний аналіз засад правового статусу суддівського самоврядування в Україні, визначення організаційно-правових проблем діяльності органів суддівського самоврядування Розвиток міжнародних відносин свідчить про необхідність перегляду теоретичних концепцій судочинства на предмет адаптації новітніх тенденцій співіснування країн у міжнародному правовому полі, зокрема, на інтеграцію України до Європейського співтовариства. При цьому організаційно- правова структура, функції та склад органів суддівського самоврядування відрізняються в різних країнах, у зв’язку з чим створення будь-якої ідеальної універсальної моделі не вважається за можливим. Суддівське самоврядування є однією з найважливіших гарантій забезпечення незалежності судів та суддів. Незважаючи на те, що Україна перебуває у стані війни, українські суди продовжують здійснювати правосуддя, але з відповідними особливостями, пов’язаними насамперед із необхідністю запобігання загрозі життю та здоров’ю суддів та всіх учасників судового процесу, зокрема на тимчасово окупованих територіях України.

The purpose of the qualification work is a scientific and theoretical analysis of the foundations of the legal status of judicial self-government in Ukraine, the determination of organizational and legal problems of the activities of judicial self-government bodies. The development of international relations indicates the need to review the theoretical concepts of the judiciary in order to adapt the latest trends of coexistence of countries in the international legal field, in particular, to the integration of Ukraine into the European Community. At the same time, the organizational and legal structure, functions and composition of judicial self-governance bodies differ in different countries, in connection with which the creation of any ideal universal model is not considered possible. Judicial self-government is one of the most important guarantees of ensuring the independence of courts and judges. Despite the fact that Ukraine is in a state of war, Ukrainian courts continue to administer justice, but with appropriate features, primarily related to the need to prevent threats to the life and health of judges and all participants in the judicial process, in particular in the temporarily occupied territories of Ukraine.
