Модернізація законодавчої бази шкільної освіти у США

Abstract

Для розвитку вітчизняної системи освіти істотне значення має вивчення досвіду розвинених країн щодо реформування законодавчої бази. Зважуючи на це, автор поставила за мету проаналізувати процеси модернізації освітнього законодавства, їх особливості у Сполучених Штатах Америки. Джерельну базу дослідження складають наукові праці вітчизняних і зарубіжних освітян, документи Департаменту освіти США, матеріали мережі Інтернет, в яких висвітлюються проблеми законодавчого регулювання управління шкільною освітою США, питання реалізації у практиці педагогічної діяльності основоположних принципів законодавчих документів. На основі вивчення науково-педагогічної літератури проаналізовано зміни у законодавчій базі шкільної освіти США. Охарактеризовано основні нормативно-законодавчі документи, серед яких Закон «Про початкову та середню освіту» (Elementary and Secondary Education Act (ESEA – 1965р.), Закон «Про рівні освітні можливості» (Equal Educational Opportunities Act (EEOA – 1974 р.), Закон «Жодна дитина не залишається поза увагою» (the No Child Left Behind Act (NCLB – 2002 р), Закон «Про успіх кожного студента» (The Every Student Succeeds Act (ESSA – 2015 р.). Базові положення законодавчих актів, прийняті протягом багатьох років, і численні недавні поправки спрямовані на усунення проблем освіти, підтримку освітніх реформ. Визначено тенденції в модернізації законодавчої бази, серед яких посилення позицій федерального законодавства, збалансування централізованих і децентралізованих механізмів управління освітою, посилення стандартизованих вимог до якості навчального процесу, оптимізація системи оцінювання діяльності навчальних закладів.

For the development of the domestic education system, it is essential to study the experience of developed countries in reforming the legislative framework. In considering this, the author set out to analyze the processes of modernization of educational legislation, their features in the United States of America. The source of research consists of scientific works of domestic and foreign educators, documents of the Department of Education of the USA, materials of the Internet, which highlight the problems of legislative regulation of school education in the United States, the issue of implementation of the basic principles of legislative documents in the practice of pedagogical activity. Based on the study of scientific and pedagogical literature, changes in the legislative basis of US school education have been analyzed. The characteristic main normative legal documents, including the law on primary and secondary education (Elementary and Secondary Education Act (ESEA – 1965), Equal Educational Opportunities Act (EEOA – 1974), The law «No child is left unattended» (the No Child Left Behind Act (NCLB – 2002), The Every Student Succeeds Act (ESSA – 2015). The basic provisions of the legislative acts and numerous recent amendments are aimed at eliminating the most common problems of education and support for educational reforms. The tendencies in the modernization of the legislative system are determined. The main of them is strengthening of the positions of the federal legislation, aimed at balancing centralized and decentralized educational management mechanisms, direction of legislative acts to strengthening standardized requirements for the quality of the educational process; emphasis on optimization of the system of evaluation of the activity of educational institutions, its orientation to actual results.
