Формування правової компетентності майбутніх менеджерів охорони здоров’я у процесі фахової підготовки

Abstract

Дисертаційна робота присвячена проблемі формування правової компетентності майбутніх менеджерів охорони здоров’я у системі фахової підготовки. Конкретизовано зміст дефініції «правова компетентність менеджерів охорони здоров’я». Проаналізовано та обґрунтовано педагогічні умови формування правової компетентності майбутніх менеджерів охорони здоров’я у системі фахової підготовки. Розроблено структурно-функціональну модель формування правової компетентності майбутніх менеджерів охорони здоров’я, до складу такої входять такі основні блоки: цільовий, аналітико-діагностичний, змістовно-операційний та результативно-оцінювальний, що утворюють складну багатофункціональну систему, інтегровану в єдину керовану систему професійної підготовки майбутніх менеджерів охорони здоров’я. Експериментально перевірена ефективність запропонованих педагогічних умов (формування системи правових знань, умінь і навичок для їх використання у фаховій діяльності; використання в освітньому процесі професійно-орієнтованих правових задач галузевої спрямованості; використання інформаційно-комунікаційних технологій для вдосконалення фахової підготовки менеджерів охорони здоров’я) формування правової компетентності майбутніх менеджерів охорони здоров’я у системі фахової підготовки.

Диссертация посвящена проблеме формирования правовой компетентности будущих менеджеров здравоохранения в системе профессиональной подготовки. Конкретизировано содержание дефиниции «правовая компетентность менеджеров здравоохранения». Проанализированы и обоснованы педагогические условия формирования правовой компетентности будущих менеджеров здравоохранения в системе профессиональной подготовки. Разработана структурно-функциональная модель формирования правовой компетентности будущих менеджеров здравоохранения, в состав такой входят следующие основные блоки: целевой, аналитико-диагностический, содержательно-операционный и результативно-оценочный, образующие сложную многофункциональную систему, интегрированную в единую управляемую систему профессиональной подготовки будущих менеджеров здравоохранения. Структурно-функциональная модель воспроизводит в динамике целенаправленный процесс формирования правовой компетентности будущих менеджеров здравоохранения, а также структурно-функциональные взаимосвязи основных блоков и их элементов целостной модели для успешной реализации этого процесса. Экспериментально проверена эффективность предложенных педагогических условий формирования правовой компетентности будущих менеджеров здравоохранения в системе профессиональной подготовки.

The theoretical analysis of domestic and foreign philosophical, psychological and pedagogical literature rergarding the world experience of providing the health care system with medical staff showed that the important problem is an imperfect and unreliable training system, in particular , training of managers. The above-mentioned negative trends that need the solution are also typical for Ukraine, that is why, the dissertation research is devoted to the problems of forming the legal competence of future health managers in the system of professional training in the process of the reformation of the healthcare branch of Ukraine. In the process of research, approaches to defining the essence of the categories related to the subject of dissertation research, in particular, “managerial competence”, “legal education”, “legal training”, “legal culture”, “legal competence” were further developed. The definition of the term “legal competence of health managers” has been further developed. Having generalized the meaning of the term “legal competence”, with the account of various branch features, the author's definition of legal competence of health managers is proposed: a set of legal competencies, personal characteristics and qualities, ethical norms, formed within the professional competence of the manager. It is noted that in the process of legal competence formation of the managers of health care institutions the understanding of the principles and norms of law and their use in professional activities, in particular: “ensuring the rights and freedoms of citizens”, “rule of law”, “supremacy of law during the realization of the functional duties” must occupy an important place. The theoretical basis for the implementation of the competence approach in the formation of legal competence of future managers of the health care system is developed, it should be based on the system of structural components, including cognitive, functional, social and personal in the process of combining on a dual basis the relationship of the fundamental competencies of health care managers. Criteria of formation (motivational-value, semantic, communicative, activity) with the corresponding fundamental description of the indicators are also singled out. Quantitative criteria for the assessing the level of legal competence formation of future healthcare managers are substantiated. The content of the definition of “pedagogical conditions” was deepened, which enabled to substantiate the pedagogical conditions for the formation of legal competence of managers of health care institutions. Thus, the main pedagogical conditions based on the results of the analysis of own experience and conclusions of the experts in the process of legal competence formation should be: formation of the system of legal knowledge, skills and abilities for their use in professional activity; use in the educational process of professionally-oriented legal tasks of branch orientation; formation of civic culture; use of information and communication technologies to improve the professional training of health managers, their profound description is made. Technique, aimed at the formation of the legal competence of future health managers in the system of professional training based on the application of the European educational standard for the training of Master in Health Care Management is developed and tested. Structural and functional model of legal competence formation of future healthcare managers has been designed, the given model includes the following main blocks: target, analytical-diagnostic, content-operational and result-evaluation, forming a complex multifunctional system integrated into a single controlled system of future health managers training. The developed structural-functional model reproduces in dynamics the purposeful process of legal competence formation of future health care managers, and structural-functional interrelations of the basic blocks and their elements of the integral model for the successful realization of this process. The diagnostic tools for studying the legal competence formation of health care managers in the system of professional training according to the following criteria have been improved: motivational-value, semantic, communicative, activity. Accordingly, the verification of the level of the components of legal competence formation of future health care managers in the system of professional training was carried out taking into account the defined structure of legal competence and the use of these formation criteria. In the process of the formative pedagogical experiment a significant increase was observed in the experimental group as compared with the control group. The statistical significance of the data was checked using K. Pearson’s chi-squared test. The study does not claim to be a comprehensive consideration of all the tasks sealing with the legal competence formation of future health care managers in the process of professional training. Further research should be aimed at clarifying the pedagogical conditions for the formation of legal competence of health managers in postgraduate education, improvement of educational technologies for teaching legal disciplines for training of managers in higher education institutions, optimization of the curricula of professional disciplines in the institutions of lifetime education.
